This manuscript from the beginning of the 13th century is of unknown origin; it contains monastic and canonistic writings, among them, for example, the monastery rule that Benedict of Nursia issued for his monastery at Monte Cassino in 529, Gregory the Great's Regula pastoralis about the ideal of the (secular) pastor of souls from the late 6th century, or the abbreviated version of a part of the Decretum Gratiani from the 12th century. This manuscript, in a strikingly narrow format, was created in Mainz and, as a gift from the Carthusians living there, it later came to the Carthusian monastery of Basel. It contains a large number of short and very short texts: in addition to some sermons, it mainly contains excerpts from theological, church historical and political treatises, including some in German. This small-format codex probably is from the Carthusian monastery of Mainz, from where it came to the Carthusian monastery of Basel, where numerous ownership notes were added. It contains a great variety of excerpts from religious, historical and other literature from the Middle Ages and antiquity. The length of the texts also varies considerably: in addition to short excerpts and two- or four-line verses about various things such as popes or bees, there are longer pieces such as Hugh of Fouilloy's De rota verae et falsae religionis or the first half of Paradisus Animae by Pseudo-Albertus Magnus. This manuscript containing legal materials from the 13th or early 14th century demonstrates the high regard in which the "Decretum Gratiani", often considered the foundation of modern canon law, was held during the middle ages. The text is bordered by the "Glossa Ordinaria" of Johannes Teutonicus, in the first revision by Barthomeus of Brescia (before 1245). The manuscript features numerous ornately illustrated initials. A 12th century manuscript (1170-1190), probably copied in Switzerland (Einsiedeln?) or in Austria. It contains the introduction In prima parte agitur (fol. 1r-7ra) and the Decretum by Gratian [Σ-group, cf. C. Wei, A Discussion and List of Manuscripts Belonging to the Σ-group (S-group)] (fol. 7ra-217va); an additio (from fol. 167vb to C.29: Adrianus papa Eberhardo Salzeburgensi archiepiscopo. 'Dignum est et a rationis... [JL 10445: 1154-59]); various excerpts of glosses (scraped on fol. 21a) and excerpta of the Summa by Rufinus (cf. R. Weigand, Die Glossen zum Dekret Gratians. Studien zu den frühen Glossen und Glossenkompositionen, Roma 1991, pp. 737-740); fragments of the Glossa Ordinaria by Bartholomaeus Brixiensis (France, middle of the 13th century) were copied onto the erasures on fol. 6va-9va. This manuscript contains the Decretum Gratiani with the Glossa ordinaria by Bartholomäus Brixiensis. It is a distinctive testimony to the masterly page layout of legal texts, where the main text is usually framed on all sides by its commentary. This copy is signed by the scribe, brother Adigherio (fol. 341v). The manuscript also is sumptuously decorated with large miniatures that introduce the main parts of the text as well as the various legal cases; in addition, there are numerous historiated initials, often very humorous (e.g. f. 2r, 127v), and figure initials. Two book illustrators from Bologna, the Master of 1346 and l'Illustratore, are the creators of this decoration that was carried out in the 1340s. In 1756, the Decretum Gratiani became part of the Bibliothèque de Genève with the bequest of Ami Lullin, who had purchased this copy from the collection of Paul and Alexander Petau. (rou)

This Decretum by Gratian is a copy of an archetype which contains an ‘archaic' text belonging to the the Σ-group and with a reduced number of paleae in the text, which were integrated partly at a later time. The codex was used in several schools in Italy and in Southern France. In the first layer of glosses is a copy of the Glossa ordinaria by Johannes Teutonicus (published in 1215/16), in the following layers there is a copy by several hands of Bartholomew of Brescia's additiones to the Glossa ordinaria, as well as glosses by canonists mainly from the 13th and 14th centuries. Important early textual witness of the Decretum Gratiani, probably even the earliest known version. As opposed to the later widespread version of 101 Distinctiones (Part I), 36 Causae (Part II) and De consecratione (Part III) with ca. 4000 Canones in all, the Decretum in this manuscript consists of only 33 Causae with ca. 1000 Canones. The numbering, however, was soon adapted to the later commonly used division into 36 Causae and preceding distinctions. This version includes some sections of text not found in later versions. The Decretum is followed by an extremely heterogeneous collection of excerpts. (len)
